Questions Residents Have Asked The City

Who within the City first initiated contact with AVAIO Digital (or its principals, affiliates, investors, or representatives) regarding a data center in Pittsburg, and on what date? Was this initiated by City staff or by a Council member? If AVAIO Digital (or its principals, affiliates, investors, or representatives) initiated contact, who did they contact? If another third party initiated the conversation with the City of Pittsburg or its representatives, who is that third party, and whom did they contact initially?

Which City staff members were involved in preparing the materials, talking points, agenda, and/or any presentation for the July 30 workshop? Were any of these materials produced in advance with input from any Council members? If so, which ones? Did any collective briefings occur (or are there planned) between city staff and the city council on the data center between January 1, 2026 and September 1, 2026 (inclusive)?

Have City staff (including the City Manager and City Attorney) or the City Council worked directly with AVAIO, PG&E, or their representatives to prepare (1) the workshop materials being presented to the public, (2) the AVAIO data center website (avaiodigital.com) or the City's sponsored data center website (PittsburgCA.gov/DataCenter), or (3) the August 3 agenda on which the data center has been placed? If that communication, coordination, and/or collaboration has taken place, please identify the individuals and the nature of it.

Have any Council members (previous or current) or City staff (previous or current) signed NDAs, MOUs, letters of intent, consulting agreements, transactional agreements, compensation agreements, or any other agreement with AVAIO, its affiliates, or their representatives? Please identify each agreement and each signatory.

Have AVAIO, its affiliates, principals, investors, or their representatives contributed to the campaign or committee of any previous or current Pittsburg City Council member? Please state amounts and dates. Have AVAIO, its affiliates, principals, investors, or their representatives contracted with, consulted for, or established any transactional or monetary relationship with any current or former City staff member (including permanent or temporary employees, or contractors)?

At the prior meeting (July 20, 2026), a speaker identified here only as P.G. was permitted to address the audience without interruption, while resident critics were instructed to “address the body.” Was that speaker's appearance or testimony coordinated in advance with the City, its staff, or any Council member? Do you acknowledge that you set speaking rules that were not enforced for all speakers, and actively silenced at least 3 speakers for not following said rules?

On July 20, 2026, was the testimony of the union representative who spoke in support of the project solicited or coordinated by the City, its staff, or the applicant? What Project Labor Agreement or other commitment, if any, underlies their support?

Pittsburg Power Company (PPC) has exercised its right to exclusively provide retail electric service to the proposed project. Does the City, through PPC, stand to gain revenue from the data center's electricity demand across Phases 1–3? Please quantify the projected revenue to the City and to PPC.

Has any Council member or official with oversight of, or a financial interest in, PPC recused themselves from deliberations or votes on the data center? If not, why not?

Beyond any advice already obtained, has the City sought or received any additional Fair Political Practices Commission (FPPC) or Government Code § 1090 guidance regarding Council members or PPC Board members voting on this project, or on any agreements from which the City's power enterprise or its utility partners stand to benefit?

On February 27, 2026, the FPPC issued advice to the City (File No. A-25-154), requested by City Attorney Donna Mooney on behalf of Mayor Dionne Adams. The FPPC concluded that, because Mayor Adams is a salaried PG&E employee of 24 years, she is disqualified under both the Political Reform Act and Government Code § 1090 from participating “in any manner” in the PPC Board's decision to enter an Interconnection Agreement with PG&E — the agreement that filing describes as follows:

When the City says these data centers will create jobs, is that referring to temporary construction jobs, permanent operational jobs, or both?

What percentage of those permanent jobs are expected to be filled by Pittsburg residents?

Once construction is complete, approximately how many workers will remain on-site during normal operations?

Has PG&E determined the existing electrical infrastructure can support these projects without reducing reliability for existing residents?

How much water is each proposed data center expected to consume annually?

Has the City completed a cost-benefit analysis comparing projected tax revenue against infrastructure, public safety, and utility costs?

Will all environmental, traffic, utility, and fiscal impact studies be available before final approval?

The Council's votes and staff's recommendations are on the record. As of today, do City staff and the City Council still support this multi-phase hyperscale data center — not a “technology park” — in light of overwhelming opposition from Pittsburg residents and the community at large? Will the City Manager (and his direct reports) and each Council member please state their support for, or opposition to, this project publicly and on the record at this time?

Are any Council members willing to (1) support a moratorium on data center development and (2) do everything in their official capacity to halt this data center project? Please state each member's position on the record.

Why is the City collecting questions in advance and pre-selecting which to answer, rather than permitting live Q&A? Will the City commit to publishing every submitted question and its response — or non-response — in full and without editing?

Could the City provide residents with a one-page summary that clearly separates temporary construction jobs, permanent operational jobs, projected tax revenue, anticipated infrastructure costs, water demand, and electrical demand for each proposed data center?

Has the fire department completed an operational review of these facilities?

Five years after these projects are completed, what measurable outcomes will determine whether they were successful?
